Appeals
An appeal is a request that a higher court review a case based on unfairness of how a case was tried, the rulings that were rendered within the trial process, or the resulting verdict or sentence.
There are two main factors usually considered when granting an appeal:
- Was there a serious legal error in the lower court that affected the outcome of the trial?
- Did the verdict go against the weight of the evidence?
Courts of Appeals
In Arkansas, there are two courts of appeal, the Arkansas Court of Appeals and the Arkansas Supreme Court. When a case is appealed, there are a number of possible outcomes. In some instances, cases are remanded for re-litigation in the lower level court, and a new trial is ordered. On occasion though, verdicts are overturned without a new trial.
U. S. Supreme Court
The U.S. Supreme Court will only hear matters that fall under Federal jurisdiction, such as a violation of Constitutional Rights. This type of appeal is left to the discretion of the U.S. Supreme Court, which will decide whether or not to review and rule on an appeal.
